The Buckeye Institute Files Lawsuit Against Biden’s Unconstitutional Vaccine Mandate on Private Businesses
Nov 04, 2021Columbus, OH – On Thursday, The Buckeye Institute filed a legal challenge against the Biden Administration’s unconstitutional vaccine mandate that applies to private companies with more than 100 employees. The lawsuit was filed directly with the U.S. Court of Appeals for the Sixth Circuit on behalf of Phillips Manufacturing & Tower Company of Shelby, Ohio, and Sixarp, LLC of Grand Rapids, Michigan.
“This unconstitutional and ill-advised vaccine mandate not only impacts companies like Phillips Manufacturing and Sixarp and their employees, but it will also devastate an already fragile labor market and supply chains that are still struggling to recover from the pandemic,” said Robert Alt, president and chief executive officer of The Buckeye Institute, who is counsel of record representing Phillips Manufacturing and Sixarp LLC. “In imposing this mandate, the Biden Administration has sought to circumvent limits on federal power, and—in so doing—has exceeded anything the Occupational Safety and Health Act allows. The mandate will cripple our economy, injure mid-size businesses who cannot find workers as it is, and—worse yet—violate the cherished principles of freedom of conscience upon which our great nation was founded.”
Buckeye’s co-counsel in the case are Patrick Strawbridge, Jeffrey M. Harris, and Daniel Shapiro at Consovoy McCarthy PLLC.
The U.S. Department of Labor announced that the vaccine mandate will be officially published in the Federal Register on Friday, November 5, 2021.
