The Buckeye Institute Reacts to SCOTUS Oral Arguments in Student Loan Cases

Columbus, OH – David C. Tryon, director of litigation at The Buckeye Institute, issued the following statement after the U.S. Supreme Court heard oral arguments in Biden v. Nebraska and U.S. Department of Education v. Brown that challenge the Biden Administration’s student loan debt cancellation plan.

“Today’s oral arguments before the U.S. Supreme Court demonstrated the importance of the legal questions presented. As The Buckeye Institute argued in its amicus brief and as several justices seemed to recognize, the Constitutional Appropriations clause would require Congress—not the Department of Education—to authorize this program. The Buckeye Institute previously filed Latta v. U.S. Department of Education, which further argues that the National Emergencies Act was not properly invoked and presents a different standing claim not before the Supreme Court today. If those challenging the program today are not successful in their cases, Buckeye expects to be successful in ours.”
